This report looks at the use made of powers contained in the Company Directors Disqualification Act 1968 concerning disqualification related to health and safety failures in the management of companies.  The report is based on a study carried out between May and November 2005.

Findings from the study were presented at stakeholder conferences on directors’ responsibilities for health and safety organised by HSE in September/October 2005, and were tabled at the Health and Safety Commission meeting in December 2005.  The Commission recognised  the need for inspectors to seek greater use by the courts of  director disqualification as a penalty; instructions on this matter were issued to inspectors in May 2006.
